Patagonia’s Privacy Notice

Effective date: April 24, 2024

Transparency and trust are the foundation of our relationship, including when you buy the products we make and engage in our efforts to fulfill our mission of saving our home planet. We understand you’ve landed on this page looking for answers and guidance about how Patagonia is using your data rather than a legal-heavy and unreadable tome. If you want to take control of how we can (or can’t) use/share/sell your personal information, visit our Privacy Rights page. This shouldn’t be complicated, the short version is we gather your name, email address, and mailing address so we can do things like deliver your order, take back what you return, and repair what needs to be fixed. We also use your information to improve our website experience and introduce you to products or environmental campaigns we’re working on that we think you may be interested in. We “sell” your name, mailing address, and purchase history to a marketing company named Epsilon that helps us distribute our seasonal journals. Read on for more details.

What are your rights?

You have the right to:

  • request a list of what personal information (if any) we disclosed to third parties for their own direct marketing purposes in the preceding calendar year and the names and addresses of those third parties.
  • know the categories of personal information we collect, use, share, and sell about you, the categories of sources from which we collected personal information about you, our purposes for collecting or selling personal information about you, the categories of personal information about you that we’ve either sold or disclosed for a business purpose, and the categories of third parties with which we have shared personal information.
  • receive a copy of the personal information we’ve collected about you, to the extent feasible. We’ll need to verify it’s actually you (and not someone else) seeking access to your personal information.
  • request that we correct inaccuracies in the personal information we have collected about you.
  • request that we delete the personal information we have collected about you. We’ll need to verify it’s actually you (and not someone else) seeking deletion of your personal information.
  • not receive discriminatory treatment for the exercise of the above privacy rights.
  • opt out of the sale or sharing of your personal information with third parties. For California residents, we do not use or disclose sensitive personal information for purposes other than as permitted under the CCPA.

If you want to disable cookies on a Patagonia affiliated site, click the “Do Not Sell or Share My Personal Information” link at the bottom of the page and follow the instructions described (this process will vary per site and is only applicable to the site through which you’ve made the request). For example, on patagonia.com click the “Disable Tracking” button under the heading “Disable Current Session Tracking.”

You can’t opt-out of non-promotional emails, such as order confirmations and updates. If you want to opt-out of promotional emails, you can click the “Unsubscribe” link at the bottom of a promotional message you’ve received. You can also select “Update My Preferences” at the bottom of the promotional message to tailor the communications we send you, including to opt-out of all such promotional communications. Note that any opt-outs you’ve requested will not affect future opt-ins.

You can opt-out of receiving text messages or calls to your phone number at any time by (i) for text messages, texting “STOP” in response to any text message you receive from us; and (ii) for calls, requesting opt-out during any call you receive from us or contacting us as set out in the “Contact Us” section below and specifying you want to opt-out of calls. Please note that your opt-out is limited to the phone number used and the specific Patagonia Service associated with the opt-out, and that your opt-out will not affect subsequent subscriptions.

What information do we collect?

We, or vendors providing services on our behalf (e.g., companies that help us process credit card payments), may collect or maintain personal information about you, such as:

  • Identity Information: your name, username, or similar identifier
  • Contact Information: your email address, phone number, delivery address, billing address
  • Financial Information: payment details
  • Transactional Information: details about your payments, orders, returns, repairs, donations
  • Technical Information: your IP address, browser type, device type
  • Account Information: your login credentials
  • Usage Information: how you navigate our website or otherwise use our products and services
  • Marketing Information: your preferences for receiving marketing communications
  • Activism Information: your engagement with activism campaigns, like signing petitions or submitting comments

How do we collect your information?

We collect your personal information when you provide it to us, for example, when you place an order or make a donation online and provide your name, email address, and shipping information. We also collect your personal information when you sign up to receive emails or advocacy alerts, attend an event in a retail store, engage with an environmental or other advocacy campaign, join a mailing list to receive catalogs, sign up to receive text messages, or choose to receive other information from us.

We may also automatically collect certain information when you use our services online. For example, we collect information about the devices you use to connect to our services (such as the IP address of your computer or numeric identifier of your mobile device) and about how you use our services online (such as what time you visit our websites and what types of content you are interested in). We, and our advertisers and ad servers, may also collect information outside the Patagonia Services to measure the success of our advertising campaigns. We may combine the information we collect with additional information from other third-party sources.

Who do we share your information with and why?

We’ll share your personal information with service providers and/or third parties for business purposes in the following scenarios:

  • We disclose all types of personal information described above with service providers who have agreed to use your information only for the purposes we request as part of running our business (such as processing credit card payments and donations or taking orders, fraud detection and security, professional or employment information for job applicants);
  • We share all types of personal information described above to our subsidiaries and affiliates and certain non-affiliated partners (such as environmental groups that we support) for content personalization and marketing purposes;
  • When we believe disclosure is appropriate to comply with applicable law or a court order, subpoena, warrant, or other legal process;
  • When we believe disclosure is appropriate to enforce our Terms of Use and other agreements and policies, to protect against fraud or other unlawful activity, or to protect our rights and the rights of third parties;

  • For purposes disclosed at the time we collect the information.

We may sell (as defined by the California Consumer Privacy Act, or “CCPA”) your name and mailing address to the trusted third-party partner below so they can send you our journals and catalogs or mailers from similar companies:

What do we do with your information?

We use your information for a variety of business purposes, such as:

  • processing and shipping orders, returns, and repairs, and responding to inquiries about products and customer service requests.
  • communicating with you about our products, activism campaigns, public policy issues, or other efforts to pursue Patagonia’s mission. This includes personalizing our marketing communications to send you information about particular products and activism issues and campaigns that we think you might be interested in.
  • improving business intelligence and maintaining, improving, and analyzing our online services (e.g., creating a better website experience or improving customer service support).
  • facilitating donations and other interactions with our partners.
  • protecting against fraud and other unlawful activity.

If you provide your email address to us, we’ll send you emails about a variety of topics, such as store events, new products, special sales, promotional offers from our affiliates or other selected business partners, environmental issues, and employment opportunities.

We also may offer programs, benefits, and other offerings to customers related to the collection, retention, or sale of personal information that may be deemed a “financial incentive” or “price or service difference” under the CCPA, but only if you opt-in to that program. These offerings may include collecting some or all of the information described above. Participating in these programs is entirely optional.

Our website also uses third-party analytics vendors such as Google Analytics. Click here for more information about how data is collected and processed in connection with the Google Analytics service. We and our third-party vendors or partners use analytics data for a variety of purposes such as to improve the design and content of our websites, to help us learn things like what pages are most attractive to all of our visitors and what promotions visitors like to see, and to gauge the success of our advertising campaigns.

We don’t use the information collected from the Patagonia Action Works site or other areas of the Patagonia Services that are identified as related to activism efforts, such as opportunities to donate to activist groups, to send you advertising and marketing for Patagonia commercial products, such as Patagonia apparel, packs, accessories, and other gear, or similar retail offers for commercial products.

How long do we keep your information?

It varies. As long as you’re a customer, your account will remain in our system. If you decide to part ways, we’ll delete your information in a reasonable timeframe (unless otherwise specified through a Privacy Rights request). We are obligated to retain certain records by law for certain business purposes, but we won’t retain them for longer than necessary.

What about cookies and other tracking technologies?

We may use “cookies,” “web beacons,” and other similar technologies to collect information in connection with our services and advertisements. A “cookie” is a text file that helps distinguish your browser from others and enables us to serve you a better online shopping experience. For example, we use cookies to save products in your shopping cart while you browse our websites and to measure the effectiveness of our marketing and advertising campaigns. Similarly, a “web beacon” is a technology that can recognize specific cookies and convey information about your browser. We may also use technologies, such as our own cookies, to provide you with personalized online display advertising tailored to your interests.

A few extra notes

Our online services are not intended for the use of individuals under the age of 16, and we do not knowingly collect information online from individuals under the age of 16.

Our websites may contain links to third-party online properties. These third parties have their own policies that govern their collection, use, and disclosure of information. We suggest that you read their privacy notices to learn about their practices. Social media provides tools that many of our customers use and enjoy, and we include links to various social media platforms on our websites. If you interact with these social media tools through our websites, your experience on those social media sites will be governed by the privacy and other policies of those sites. We have reasonable physical, electronic, and administrative measures in place to help safeguard the security of the information we collect. Nevertheless, transmission via the Internet is not completely secure and we cannot guarantee the security of information about you.

We are based in the U.S. and the information we collect is governed by U.S. law. If you are accessing our services from outside the U.S., please be aware that information collected may be transferred to, processed, stored, and used in the U.S. and other jurisdictions. Data protection laws in the U.S. and other jurisdictions may be different from those of your country of residence. Your use of our services, or decision to provide information through our services, therefore constitutes your consent to the transfer to and from, processing, usage, sharing, and storage of information about you in the U.S. and other jurisdictions as set out in this Privacy Notice.
